End User License Agreement

This is the agreement shown in the App Store and TestFlight. The plain-language version is on the terms page.

1. What This Is

Voltpony ("the App") is an independent, unofficial companion app for the Ford Mustang Mach-E, provided free of charge. The App is NOT affiliated with, endorsed by, or sponsored by Ford Motor Company. "Ford", "Mustang", "Mach-E" and "FordPass" are trademarks of Ford Motor Company, used here only to describe compatibility.

2. License

You are granted a personal, non-exclusive, non-transferable, revocable license to use the App on Apple-branded devices you own or control. You may not sell, rent, sub-license or redistribute the App, or attempt to derive its source code except to the extent that restriction is unenforceable by law.

3. Your Vehicle, Your Account

The App uses credentials you supply to access a vehicle you are authorized to access. You are solely responsible for having that authorization. Sign-in is performed on Ford's own web page; the App does not receive or store your password. Access tokens are held in the device Keychain and are used only from your device. There is no developer-operated server and no developer account.

4. Risk To Your Ford Account

The App interoperates with connected-vehicle interfaces that Ford operates for its own application. Those interfaces are not published for third parties. Ford has, in documented cases, restricted accounts used with unofficial software. YOU ACCEPT THAT RISK. You are strongly advised to use a secondary Ford account added to your vehicle as a driver rather than your primary account. The developer cannot restore, appeal or influence a restricted Ford account.

5. Vehicle Commands And Safety

The App can lock, unlock, precondition and change charging settings. Commands travel over the internet to Ford's systems and MAY BE DELAYED, REORDERED, DUPLICATED OR FAIL ENTIRELY, and may report success when the vehicle has not acted. You are responsible for using these functions safely and lawfully. DO NOT RELY ON THE APP IN AN EMERGENCY OR IN ANY SAFETY-CRITICAL SITUATION. Do not unlock a vehicle you are not authorized to access.

6. Accuracy

Range, charge, location and status figures originate from your vehicle via Ford and are estimates. They may be stale, incorrect or unavailable. Do not plan around them anything you cannot afford to get wrong.

7. Availability

Ford may change, restrict or discontinue the interfaces the App depends on at any time and without notice. Features may stop working, or the App may stop functioning entirely and permanently. No guarantee of continued operation is offered or implied.

8. Pre-Release Software

Builds distributed through TestFlight are pre-release, may contain defects, and expire. Features may change or be removed without notice.

9. No Warranty

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

10. Limitation Of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE DEVELOPER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, OR FOR LOSS OF VEHICLE ACCESS, LOSS OF FORD ACCOUNT ACCESS, OR LOSS OF DATA, ARISING FROM OR RELATING TO THE APP. Some jurisdictions do not allow these exclusions, in which case they apply only to the extent permitted.

11. Privacy

The App collects no personal data, contains no analytics and no advertising, and includes no third-party SDKs. See https://voltpony.app/privacy.

12. Termination

This license ends automatically if you breach it, and you may end it at any time by deleting the App. Sections 4 through 10 survive termination.

13. General

If any provision is held unenforceable, the remainder stays in force. This agreement is between you and the developer only; Apple is not a party to it and is not responsible for the App. Apple and its subsidiaries are third-party beneficiaries of this agreement and may enforce it against you.
